Terms and Conditions

1. General Terms

  • By booking a vehicle with Omni Lux Rentals, you acknowledge and agree to the following terms and conditions. This applies to both vehicles listed by Omni Lux Rentals and those listed by individual hosts on our platform.

2. Eligibility and Documentation:

  • The Renter must provide a valid driver's license in good standing (not expired, suspended, or revoked).
  • The Renter must provide proof of insurance covering the rental period, including liability, collision, and theft.

3. Rental Period:

  • The vehicle must be returned by the agreed-upon return time on the scheduled return date, unless a reservation extension has been arranged in advance. A late fee of $50 per hour will be charged for every hour the vehicle is returned late. Alternatively, the Renter may be billed for an additional full day of rental. If the vehicle is not returned within 24 hours of the scheduled return time, the Owner reserves the right to report the vehicle as stolen.

4. No Smoking

  • Smoking of any kind (including cigarettes, cigars, marijuana, or e-cigarettes) inside the vehicle is strictly prohibited. A cleaning fee of $500 will apply if this policy is violated.

5. No Reckless Driving or Excessive Speeding

  • The Renter agrees to operate the vehicle safely and within the legal speed limits at all times. Reckless driving or excessive speeding will result in termination of the rental agreement and may incur additional fees. The Owner reserves the right to charge for any traffic violations or damage caused by reckless driving.

6. No Toll Lanes

  • The vehicle is prohibited from being driven through toll lanes. Any toll charges incurred during the rental period are the responsibility of the Renter. The Renter agrees to reimburse the Owner for any toll charges incurred.

7. Vehicle Cleanliness

  • The vehicle must be returned in the same clean condition as it was at the time of pickup. Excessive trash, dirt, or stains will result in a cleaning fee of up to $300.

8. Refueling or Charging Requirement

  • Gasoline Vehicles: The Renter agrees to return the vehicle with the same fuel level as when it was picked up. Failure to do so will incur a $100 refueling fee.
  • Electric Vehicles: The vehicle must be returned at the same charge level as when it was picked up. Failure to meet this requirement will incur a $50 recharging fee.

  • Charges for refueling or recharging will be deducted from the Renter's deposit or invoiced as a bill.

9. Accidents and Damage

    The Renter is responsible for all damages to the vehicle during the rental period. In case of an accident or damage, the Renter must:

  • Notify the Owner immediately.
  • File a police report and provide a copy to the Owner.
  • Reimburse the Owner for any repair costs, loss of rental income, and any associated fees, insurance deductible, etc

10. Cancellation and Refund:

  • Cancellations made at least 48 hours prior to the scheduled pickup time will receive a full refund. For cancellations made between 24 and 48 hours before the scheduled pickup, a partial refund may be provided, depending on the Owner's and Vehicle's specific terms and policies, as well as the timing of the cancellation. Cancellations made within 24 hours of the scheduled pickup are non-refundable

11. Insurance

  • The Renter must provide proof of insurance that covers the full value of the vehicle during the rental period.
  • If the Renter does not have personal insurance, the owner and/or company may offer insurance for an additional fee.
  • In the event of damage, the Renter is responsible for the deductible amount selected if opting for owner/company provided insurance.

12. Driving Restrictions

  • The vehicle may not be driven out of state or to restricted areas unless explicitly authorized in written communication by the owner. Additional fees for mileage and maintenance may apply

13. Damages and Liability

  • The Renter is fully responsible for any damage to the vehicle during the rental period, including body, interior, tires, and electrical systems. The Renter is also responsible for any towing or impound fees.

14. Authorized Drivers

  • Only the driver(s) registered at the time of booking are permitted to operate the vehicle. No other individuals are authorized to drive the vehicle at any time unless they are specifically listed as an approved driver, and their driver's license and insurance coverage have been verified and confirmed. The Renter is responsible for ensuring that all drivers meet these requirements. Unauthorized drivers will be in breach of this Agreement and may result in immediate termination of the rental, with additional fees or penalties applied

15. Indemnification

  • The Renter agrees to indemnify and hold harmless the Owner and any vehicle hosts from any claims, damages, or liabilities arising from the Renter's use of the vehicle during the rental period.

16. Governing Law

  • This Agreement shall be governed by and construed in accordance with the laws of the state of Nevada.

17. Host Protections

    For hosts listing their vehicles, the following terms apply:

  • Hosts must ensure their vehicles are maintained in a safe and operational condition.
  • Hosts are responsible for ensuring their vehicles are adequately insured
  • Hosts are protected under the indemnification clause of this Agreement.

18. Agreement Acceptance

  • By proceeding with the booking process, you acknowledge that you have read, understood, and agree to these Terms and Conditions. This serves as a binding contract between you and Omni Lux Rentals.
